Privacy Policy

I. INTRODUCTION

This document is the Privacy Policy of Britenet Limited Liability Company, located at 30 Karolkowa Street, 01-207 Warsaw, NIP 951-219-77-37, REGON 140727009, KRS: 0000264919, (hereinafter: Britenet). Britenet's Privacy Policy (hereinafter: Policy) defines the rules, the way of processing and using data and information from job candidates, clients and users of all websites belonging to Britenet, i.e. www.britenet.com.pl and the use of cookies.

In connection with the User's use of the Website, the Administrator collects data to the extent necessary to provide the individual services offered, as well as information about the User's activity on the Website. Detailed rules and purposes of processing personal data collected during the User's use of the Website are described below.

II. DEFINITIONS

Controller (of the data) - means a natural or legal person, public authority, entity or any other entity that alone or jointly with others determines the purposes and means of processing personal data. The controller of the data is Britenet Sp. z o. o. based in Warsaw at Karolkowa 30, 01-207.

Anonymization - a change in personal data as a result of which the data loses the character of personal data.

RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 of April 27, 2016. (Official Journal of the EU L 119 of 04.05.2016)

Personal data - any information related to an identified or identifiable natural person. A person is considered directly or indirectly identifiable by reference to an identifier, such as a name, identification number, location data, Internet identifier or one or more factors specific to physical, physiological, genetic, mental, economic, cultural or social.

Personal data processing - is any automated or non-automated operation or set of operations performed on personal data or sets of personal data and includes collection, recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or linking, limiting, deleting or destroying personal data.

Specialist - a job candidate offered by Britenet to its clients.

Services - should be understood as the services provided by Britenet electronically, through the website.

User - a job candidate, a contest participant, a person asking a question, a person recommending a friend for a job, a person visiting websites belonging to Britenet.

Consent of the data subject - means any freely specified, specific, informed and unambiguous indication of the data subject, by means of a statement or explicit affirmative action, consenting to the processing of personal data related to him.

III. PURPOSES AND BASIS OF DATA PROCESSING IN THE SERVICE

Personal data of all persons using the Service (including IP address or other identifiers and information collected through cookies or other similar technologies), and who are not registered Users (i.e. persons who do not have a profile on the Service) are processed by the Administrator:

  • for the purpose of providing services electronically in terms of providing Users with access to content collected on the Website - in which case the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) RODO);
  • for analytical and statistical purposes, in which case the legal basis for the processing is the legitimate interest of the Administrator (Article 6(1)(f) of the RODO), which consists in conducting analyses of Users' activities, as well as their preferences in order to improve the functionalities used and services provided;
  • in order to assert or defend against claims - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the DPA) to protect your rights;
  • in order to process an inquiry for the provision of services - the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) of the DPA);
  • in order to participate in recruitment - the legal basis for processing is the necessity of the processing for the performance of the contract (Article 6(1)(b) of the DPA) and in the case of consent to participate in future recruitment, the legal basis is the consent of the data subject (Article 6(1)(a) of the DPA);
  • for the Administrator's marketing purposes - the principles of processing personal data for marketing purposes are described in Section 4.Marketing.

The User's activity on the Service, including his/her personal data, is recorded in system logs (a special computer program used to store a chronological record containing information about events and activities concerning the computer system used to provide services by the Administrator). The information collected in the logs is processed primarily for purposes related to the provision of services. The Administrator also processes them for technical, administrative purposes, for the purpose of ensuring the security of the IT system and the management of this system, as well as for analytical and statistical purposes - in this regard, the legal basis for processing is the Administrator's legitimate interest (Article 6(1)(f) RODO).

IV. MARKETING

  1. Contact forms - The Administrator provides the possibility to contact him using electronic contact forms. Using the form requires providing personal data necessary to contact the User and respond to the inquiry. The User may also provide other data to facilitate contact or handling of the inquiry. Provision of data marked as mandatory is required in order to accept and service the inquiry, and failure to provide such data will result in the impossibility of service. Provision of other data is voluntary. Personal data is processed for the purpose of handling a request submitted via the contact form - the legal basis for processing is the necessity of processing for the performance of the service contract (Article 6(1)(b) RODO); with regard to the processing of optional data, the legal basis for processing is expressed consent (Article 6(1)(a) RODO);
  2. Newsletter - The Administrator processes Users' personal data in order to carry out marketing activities, consisting of directing e-mail notifications of interesting offers or content, which in some cases contain commercial information (newsletter service). The Administrator provides the newsletter service to persons who have provided their e-mail address for this purpose. Provision of data is required in order to provide the newsletter service, and failure to do so results in the inability to send the newsletter. Personal data is processed for the purpose of directing marketing content to the User as part of the newsletter - the legal basis for processing is the Administrator's legitimate interest (Article 6(1)(f) RODO) in connection with the consent to receive the newsletter.
  3. Telephone contact - The Administrator processes Users' personal data in order to carry out marketing activities that involve contacting the User via telephone calls. The Administrator provides the service to those who have provided their telephone number address for this purpose. Provision of data is required in order to provide the service, and failure to do so results in the impossibility of its implementation. Personal data is processed for contact purposes, and the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the RODO) in connection with the consent to contact by phone.

V. POLICY ON THE SERVICE'S USE OF COOKIES.

Cookies (so-called "cookies") are IT data, in particular text files, which are stored in the Service User's terminal equipment and are intended for use on the Service's websites. Cookies usually contain the name of the website from which they originate, the time they are stored on the terminal equipment and a unique number.

The Administrator uses so-called service cookies primarily to provide the User with services provided electronically and to improve the quality of such services. In this regard, the Administrator and other entities providing analytical and statistical services to the Administrator use cookies to store information or access information already stored in the User's telecommunications end device (computer, phone, tablet, etc.). Cookies used for this purpose include:

  • "Service" cookies - cookies, which are necessary for the use of the Website, are automatically installed on the User's device. Their use is necessary for the provision of the telecommunications service (data transmission to display content) - the User does not have the option to opt out of these cookies if he wants to use the Website.
  • Analytical and marketing cookies - Analytical and marketing cookies are not automatically installed by the Administrator. The User may grant the Administrator permission to install analytical and marketing cookies by giving consent when opening the Website (accessing the website) or by selecting the "Manage cookies" option in the footer of the website.
  • The User may consent to the installation of analytical and marketing cookies by clicking the "I accept" button on the banner that appears after entering the website. The Administrator will then be authorized to install analytical and marketing cookies according to the settings of the browser used by the User (in the case of default settings, all cookies are installed). The User may agree to install only analytical or marketing cookies. To do so, simply click the "Manage cookies" button on the banner that appears after entering the website and select the cookies that the User wants to agree to install. The User may withdraw the consent given at any time.

VI. PERIOD OF PROCESSING OF PERSONAL DATA

The period of data processing by the Administrator depends on the type of service provided and the purpose of processing. As a general rule, data are processed for the duration of providing the service or fulfilling the order, until the withdrawal of the expressed consent or filing an effective objection to data processing in cases where the legal basis for data processing is the legitimate interest of the Administrator. The period of data processing may be extended if the processing is necessary to establish and assert or defend against possible claims, and thereafter only if and to the extent required by law. After the expiration of the processing period, the data shall be irreversibly deleted or anonymized.

VII. USER RIGHTS

The user is entitled to:

  • Access to the content of the data and request rectification, deletion, restriction of processing,
  • to data portability
  • To object to the processing of data,
  • lodge a complaint with the supervisory authority dealing with the protection of personal data.

To the extent that User Data is processed on the basis of consent, you may withdraw it at any time by contacting the Administrator or using the functionalities provided on the Website. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. The User has the right to object to the processing of data for marketing purposes, if the processing is carried out in connection with the legitimate interest of the Administrator, as well as - for reasons related to the User's specific situation - in other cases where the legal basis for data processing is the Administrator's legitimate interest (e.g. in connection with the implementation of analytical and statistical purposes).

VIII. DATA RECIPIENTS

In connection with the performance of services, personal data will be disclosed to external entities, including in particular IT service providers and entities such as marketing agencies (for marketing services). If the User's consent is obtained, his/her data may also be shared with other entities for their own purposes, including marketing purposes. The Administrator reserves the right to disclose selected information concerning the User to competent authorities or third parties who make a request for such information, based on the relevant legal basis and in accordance with the provisions of the applicable law.

IX. TRANSFER OF DATA OUTSIDE THE EEA AREA

Personal data may be transferred to third countries in case the services that the Administrator provides are also to be performed in the territory of a third country.

Personal data may also be transferred to entities providing Britenet with tax, legal, auditing and billing advice if they conduct their business in a third country.

In each of the above cases, we secure the processing of the User's personal data. The Administrator enters into confidentiality agreements and personal data processing in a manner that complies with the provisions of generally applicable law in the European Union and Poland in the field of personal data protection and on terms designed to ensure the security of personal data processing. The Administrator does not transfer personal data to international organizations and also to third countries, if such transfer is not possible or is excluded under generally applicable laws.

X. RETENTION PERIOD OF PERSONAL DATA

Your personal data will be stored for the following periods:
a) data processed on the basis of your consent (Article 6(1)(a) RODO)-until you withdraw your consent to its processing, unless the controller determines earlier that the data has become obsolete;
b) data processed for the purpose indicated in point V lit. 2) above - for the period necessary to take and carry out actions at your request as a data subject before entering into a contract;
c) data processed in case of entering into a contract with you and for the purpose indicated in point V letters 3) and 4) above - for the period necessary for the performance of the contract linking you with the controller, as well as for the period of limitation of claims and criminal actions that may arise from the contract, and for the period required by law, such as tax law. The administrator may keep your personal data for a longer period than indicated only if there is another basis for processing your personal data as specified in Article 6(1) of the RODO;

XI. CHANGES IN THE CONTENT OF THE POLICY

Due to development and changing laws, the rules set forth in this Privacy Policy may change. The User will be informed of the change of these rules by posting the new content of this document on the website:www.britenet.com.pl/polityka
